Heard learned Counsel for the applicant and learned A.G.A. Supplementary affidavit has been filed by the learned counsel for the applicant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. , but his name has been disclosed by witness Surendra Singh during investigation. According to his statement the role of catching hold is assigned to the applicant and role of causing the injury is attributed to co-accused Maqsood. The case of the applicant is distinguishable with the case of co-accuse Maqsood.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Babbu involved in Case Crime No. 384 of 2006, under Sections 302/34 I.P.C. , Police Station Patwaia, District Rampur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
