Heard learned counsel for the petitioners as well as learned Standing counsel appearing for Respondents no. 1 to 4 and perused the record.

It is the case of the petitioners that in response to a notification dated 9.9.2006 issued by the Director of Education (Basic), Respondent no.3, the Manager of the rival Committee of Management, Respondent no.5, filed an application for the institution in question to be included under the grant-in-aid scheme of the State Government. The submission of the petitioner is that condition no.11 of the said notification mentions that institutions in which there is dispute with regard to management shall not be considered. Learned counsel for the petitioner contends that the application of the Respondent no.5 has been entertained despite the petitioners having filed several representations stating that they are the actual Committee of Management and there is a dispute with regard to the management of the institution.

It is not the case of the petitioner that any final order has been passed by the respondent-authorities. This Court has no doubt that the respondent-authorities shall decide the matter relating to the inclusion of all institutions including that of the petitioner institution under the grant-in-aid scheme in terms of their own notification/circular and as such before any decision is taken by the respondent-authorities, this Court would not be inclined to interfere in the process.

With the aforesaid observation this writ petition stands disposed of. No order as to cost.
