It is submitted by learned counsel for the applicant that the applicant is father-in-law of the deceased and there are general allegation in respect of the demand of dowry and subjecting the deceased with cruelty. There is no specific allelgation against the applcant. Co-accuse Kamla, the mother-in-law of the deceased has been released on bail by this court on 30.10.2006 in Criminal Misc Bail Application No. 23068 of 2006. The case of the applicant is distinguishable with the case of the husband of the deceased
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Omi involved in Case Crime No. 150 of 2006, under Sections 498-A and 304-B I.P.C. and Sections ¾ Dowry Prohibition Act, Police Station Kotwali Dehat , District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
