Heard learned Counsel for the applicant , learned A.G.A. and Sri T.K. Mishra learned counsel for the complainant.
It is submitted by learned counsel for the applicant that thje applicant is jeth of the deceased and he is living separaely. He was having no concerned with the family affairs of the deceased and her husband. According to the post mortem examination report no injury was seen on the person of the deceased. The cause of death could not be ascertained, hence the viscera was preserved. The case of the applicant is distinguishable with the case of the husband of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rakam Singh involved in Case Crime No. 264 of 2006, under Sections 304-B I.P.C., Police Station Murad Nagar, District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
