Heard Sri Rajendra Rai, learned counsel for the applicants and learned AGA.
The learned counsel for the applicants submitted that no mark of injury was found in the skull of injured Udai Upadhyaya alias Dabbu by the Medical Board. The learned counsel submitted that after the opinion of the Medical Board final report was submitted in the matter. The learned counsel urged that the trial court has summoned the applicants on the basis of protest petition
Issue notice to the respondent no. 2 for filing counter affidavit within four weeks. The learned AGA may also file counter affidavit within the said period. Rejoinder affidavit may be filed within two weeks thereafter.
List after the expiry of the aforesaid period.
Further proceedings in criminal complaint case No. 106 of 2006-Basant Lal Versus Bhola and others, under sections 323, 504, 308, I.P.C., Police station M.M. Gate, district Agra, pending before Judicial Magistrate/Additional Civil Judge (Junior Division) Court No. 41, Agra, shall remain stayed till the next date of listing.
Office is directed to issue certified copy of the order to the learned counsel for the applicants on payment of usual charges within twenty four hours.
