Heard learned counsel for the petitioner as well as learned Standing counsel appearing for the respondents. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.

It is the case of the petitioner that the election of the Committee of Management in question was held on 18.9.2006. thereafter relevant papers relating to the election were forwarded to the District Inspector of Schools on 20.9.2006. The Observer also submitted his report to the District Inspector of Schools on 22.9.2006 and the papers have thereafter been forwarded by the District Inspector of Schools to the Joint Director of Education for necessary order being passed by the Regional Level Committee constituted under Government Order dated 19.10.2000, of which the Respondent no.2 Joint Director of Education is the Chairman. The submission of the learned counsel for the petitioner is that there is no rival Committee of Management and as such there is no dispute with regard to the election of the Committee of Management and as such there should be no delay in the Regional Level Committee taking a decision with regard to the grant of recognition of the election of the petitioner Committee of Management held on 18.9.2006.

Learned Standing Counsel has, however, submitted that the matter has to be decided by the Regional Level Committee which meets at regular intervals and the matter would be placed before the Regional Level Committee at the earliest.

Having heard learned counsel for the parties and considering the facts and circumstances of this case, this writ petition is finally disposed of with the direction that the matter relating to the grant of recognition of the election of the Committee of Management in question be decided by the Regional Level Committee, of which Respondent no.2 is the Chairman, in accordance with law, after giving opportunity of hearing to the petitioner and other concerned parties, if there be any, expeditiously, preferably within a period of six weeks from the date of filing of a certified copy of this order before the Respondent no.2.

With the aforesaid observation and directions this writ petition stands disposed of. No order as to cost.
