Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the F.I.R. the applicant and four other co-accused persons discharged shots by their fire arm consequently, the deceased injury but during investigation the eye witnesses Chandra Pal, Nahar singh and Dariyav Singh stated that the injuries were caused by Tej Pratap and Raghubir Singh by their licensed pistol and country made pistol at the exhortation of the applicant. According to their statement only the role of exhortation has been assigned to the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jal Prasad alias Jag Prasad involved in case crime no. 243 of 2006 under Sections 147,148,149,302 I.P.C., P.S. Highway District Mathura be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
