On account of failure on the part of the learned counsel for the defendants-appellants in taking requisite steps for issuance of notices to the respondents nos. 1 to 4, pursuant to the order dated 14.12.1982 passed by the Court on the Second Appeal, the case is listed today under Chapter XII, Rule 4 of the Rules of the Court .
The case has been taken -up in the revised list. Learned counsel for the defendants -appellants is not present.
Even though the case is listed today under Chapter XII, Rule 4 of the Rules of the Court, the requisite steps have not been taken.
In the circumstances, the Court has no option, but to dismiss the Second Appeal as against the respondents nos. 1 to 4 for want of prosecution under Chapter XII, Rule 4 of the Rules of the Court.
As the respondents nos. 1 to 4 are the only respondents in the Second Appeal , the Second Appeal is dismissed for want of prosecution under Chapter XII, Rule 4 of the Rules of the Court.
