Heard Sri Dinesh Kumar Gupta, learned counsel for the applicants and learned AGA.
The learned counsel for the applicants submitted that case crime No. 161 of 2005 under sections 147, 148, 149, 302, I.P.C., Police station Chikasi, district Hamirpur was registered on 27.8.2005 on the basis of first information report lodged by applicant no. 3 about the murder of his brother. The learned counsel urged that an application under section 156 (3) Cr.P.C. was made one month after the registration of first information report by opposite party no. 2 and an order for registration and investigation was passed by the learned Magistrate and after investigation final report was submitted. The learned counsel contended that the applicants have been summoned on the basis of protest petition filed by opposite party no. 2.
Issue notice to the respondent no. 2 for filing counter affidavit within four weeks. The learned AGA may also file counter affidavit within the said period. Rejoinder affidavit may be filed within two weeks thereafter.
List after the expiry of the aforesaid period.
Further proceedings in Special Case No. 70 of 2006-Smt. Kaushilya Versus Karan Singh and others, under sections 392, 436, 427, I.P.C., Police station Chikasi, district Hamirpur, pending before Special Judge (D.A.A. Act), Hamirpur, shall remain stayed till the next date of listing.
Office is directed to issue certified copy of the order to the learned counsel for the applicants on payment of usual charges within twenty-four hours.
