The contempt application has been filed against the opposite parties for non-compliance of the order dated 12.4.2002 passed by the Writ Court. The counter affidavit of opposite party No.1 reveals that the judgment was not complied with on account of the fact that the opposite parties had filed a Special Appeal No.443 of 2002.
The learned counsel for the applicant stated that the Special Appeal was dismissed by judgment dated 16.10.2006, a copy of which has been enclosed in the listing application dated 17.11.2006. In view of the aforesaid Sri K.R.Singh, the learned Standing Counsel appearing for the opposite parties is directed to intimate the District Magistrate that he should now comply with the order of the Writ Court dated 12.4.2002 and pass a consequential order within one month and be intimate the same to Court.
List on 9.1.2007. In the meantime, if the order is not complied with, the applicant may file an impleadment application impleading the present District Magistrate.
A certified copy of this order shall be made available to the learned Standing Counsel appearing for the respondents within three days free of cost.
