It is vehemently contended that the petitioners are Jeth and jethani and living separately but they have malafidely been roped in the alleged offence.
Issue notice to respondent no.3 through registered post with AD returnable within four weeks. Steps to be taken within a week.
Respondents no.1 and 2 are represented by the learned Additional Government Advocate. He prays for and is allowed four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List this matter after two months.
Considering the submissions and looking to the facts of the case, in the meanwhile, it is provided that the petitioners shall not be arrested in Case Crime No. 633 of 2006, under Sections 498-A, 323 and 504 I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station Quarsi, District Aligarh till any credible evidence is collected during the course of investigation or till the submission of the charge sheet whichever is earlier provided they appear before the Chief Judicial Magistrate, Aligarh within two weeks and furnish two sureties each in the like amount to his satisfaction and further shall appear before the Investigating Officer as and when required and render all cooperation in the investigation. However, the investigation shall continue and be concluded expeditiously.
