Vasant Kumar v. Mandal Rail Prabandhak Northern Railway & Others - WRIT - C No. 26273 of 2001 RD-AH 20360 (30 November 2006)
Hon'ble Yatindra Singh,J.
Hon'ble Ran Vijai Singh, J.
Petitioner's licence was cancelled by the Railway Authority on 5.3.2001. However, liberty was granted to the petitioner to move a representation within a month. Petitioner filed representation which was also rejected on 11.6.2001. Hence this writ petition.
We have heard learned counsel for the petitioner and counsel for the respondents.
The representation of the petitioner has been rejected on the ground that his conduct is not good. We see no justification to interfere with the order. However, in case the entire money has been paid and the petitioner is willing to pay the new licence fee then this order will not prohibit the Railway Authority to consider the petitioner's application for running the tea stall at Jaunpur Railway City Station.
With this observations this writ petition is dismissed.
