This is a writ petition against the order dated 2.1.2006 cancelling the petitioner's licence for fair price shop.
We have heard counsel for the petitioner and the Standing counsel for the respondents.
The licence of the petitioner has been cancelled on the ground that one licence holder, namely, Savant Kumar has resigned and the petitioner Smt. Chameli Devi is uneducated. According to the petitioner her other sons are educated and are willing to run the fair price shop.
In the circumstances of the case, it will be appropriate that the petitioner may file fresh representation before respondent no.2. In case the representation is filed, the same may be decided by the said respondent by a reasoned order at an early date, if possible, within one month from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioner.
With these observations the writ petition is disposed of.
