Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents. With consent of the learned counsel for the parties, this writ petition is being disposed of at this stage without calling for a counter affidavit.

The petitioner-Institution is a Junior High School. In terms of the Government Order dated 13.8.1997 the petitioner applied for being granted recognition as a Junior High School. Such application was filed on 9.12.1998 and the same was forwarded by the District Basic Education Officer, Deoria to the respondent no. 2, the Assistant Director of Education (Basic), VIIth Region, Gorakhpur/Secretary, Regional Committee on 22.2.1999 but, it has been contended by the learned counsel for the petitioner, that till date no orders either accepting the application or rejecting the same have been passed by the respondent no. 2 despite the petitioner having filed several representations in this regard.

Having heard learned counsel for the parties and considering the facts and circumstances of this case, this writ petition is finally disposed of with the direction that in case if, with regard to his grievances made in this writ petition, the petitioner files a comprehensive representation before the respondent no. 2, the Assistant Director of Education (Basic), VIIth Region, Gorakhpur/Secretary, Regional Committee alongwith a certified copy of this order annexing therewith the copy of the application dated 9.12.1998 and the forwarding letter of the District Basic Education Officer, Deoria dated 22.2.1999, the same shall be considered and decided by the said respondent no. 2, in accordance with law, as expeditiously as possible, preferably within a period of two months from the date of filing of the same.

With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to costs.
