Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is Nandoi of the deceased. He was living separately. He was having no concern with the family of the deceased and her husband even he was having no concern with the demand of dowry and subjecting the deceased to cruelty. The case of the applicant is distinguishable with the case of the other co-accused. According to the post mortem examination report the cause of death could not be known, hence he viscera was preserved.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Udai Veer Singh involved in case crime no. 1796 of 2006 under Sections 304-B,498-A I.P.C.,and ¾ D.P. Act P.S. Najibabad District Bijnore be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
