Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that according to the prosecution version the marriage of the deceased was solemnized about 6 years prior the alleged accident. The applicant no.1 is the father in law of the decease and applicant no.2 is mother in law of the deceased. The cause of death is burn injuries. The allegation made against the applicants are of general in nature. They were having no concern with the demand of dowry and subjecting the deceased to cruelty. They were living separately. They were having no concern with the family of the deceased and her husband. The case of the applicants are distinguishable with the case of other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Budhi Ram Vishwakarma and Smt. Sudama Devi
involved in case crime no. 689 of 2006 under Sections 498-A,304-B I.P.C., and ¾ Dowry Prohibition Act P.S. Bhadohi District Sant Ravidas Nagar be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
