Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. His name has been disclosed in the second F.I.R. His name has been disclosed by co-accused Malkhan Singh. Subsequently, at his pointing out one belt and a wrist watch of the deceased has been recovered. It is said that recovered articles are not in way connected with the property of the deceased and it has not been supported by any independent witness. There is no other evidence against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Mahesh Pal involved in Case Crime No. 542 of 2006, under Sections 364,302 and 201 I.P.C., Police Station Fetch Ganj West, District Bareilly be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
