Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that according to the prosecution version the alleged incident had taken place in the dark hours of night at about 10.30 p.m. on 15.9.2006. It is alleged that some unknown persons committed the alleged offence but on the basis of doubt and suspicion the applicant No.1 Nisar was named in the F.I.R. but during investigation the statement of the witnesses recorded and they stated that the applicants were seen in disturbed condition. The second evidence is of extra juridical confession. Thee is no other credible evidence against the applicants. The applicants were not having any motive or intention to commit the alleged offecne.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Nisar and Raisuddin involved in case crime no. 626 of 2006 under Sections 302 I.P.C., P.S. Mandawar District Bijnor be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
