We have heard Sri S.P. Gupta, Senior Advocate and Sri S.D. Singh for the petitioner and Standing Counsel and Sri S.K.Misra for the respondents.
Counsel for the parties state that the points involved in this petition are similar as involved in Writ Petition No.15087 of 2004 decided on 24.1.2006. In view of the statement, on the same reasoning the present writ petition is also disposed of with the similar following observations .
Accordingly, after hearing learned counsel for the parties, we dismiss these petitions as having become infructuous and leave the legal question involved to be determined in some other appropriate case. However, the interim order passed by this Court in the writ petitions stand discharged and shall not be treated as precedent in future and the respondents are restrained from taking any action against the petitioners for the sale of levy/free sale sugar pursuant to the interim order passed by this Court.
