Heard Sri Dhirendra Kumar Srivastava, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the name of the applicant came to fore from the confessional statement of co-accused.
The application is finally disposed of with the direction to the applicant to surrender before the Additional Chief Judicial Magistrate, Banda within two weeks. In case the applicant moves an application for bail before the Additional Chief Judicial Magistrate (N..C.Railway) /Sessions Judge, Banda, the same shall be decided expeditiously more preferably the same day in view of the guidelines laid down by Full Bench of this Court in the case of Smt. Amarawati and another Versus State of U.P. 2004 (50) ACC 742.
The arrest of the applicant in case Crime No. 9 of 2006-State Versus Sanjay Nishad and others (Complaint Case No. 5691/IX of 2006) shall remain stayed for a period of two weeks from the date of this order.
