It is submitted by learned counsel for the applicant that the alleged occurrence has taken place in the dark hours of night. The applicant has been named in the F.I.R. only on the basis of doubt and suspicion. There is no direct eye witness account. During investigation the evidence of last seen has been collected by the I.O.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Radha Kishan alias Radha Krishna involved in case crime no. 325 of 2006 under Sections 304,323,504 I.P.C., P.S. Mohammdabad District Farrukhabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
