Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the F.I.R. the role of catching hold is assigned to the applicant and co-accused Sheesh Pal. The allegation of causing injury is against the co-accused Sanjay and Anil. The case of the applicant is distinguishable with the case of Sanjay.
In reply to the above contention it is submitted by the learned A.G.A. that the applicant is threatening from the Jail.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Neeraj involved in case crime no. 399 of 2006 under Sections 302,307,504 I.P.C., P.S.Modi District Ghaziabad be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with the condition that the applicant shall report to the court of C.J.M. concerned in the first week of each month till conclusion of the trial to show his good conduct.
In default of the above condition it shall be open to the learned Session Judge concerned to canelhe bail granted to him on the police report.
