Heard Sri Ajit Kumar Singh, learned counsel for the applicant, Sri P.C. Srivastava, learned counsel for opposite party no. 4 Shri Dhar Singh, learned AGA and have perused the materials on record.
Charges against opposite parties were framed on 16.11.2006. The contention of the learned counsel for the applicant is that opposite party no. 4 absconded for delaying the trial and pressurised the sole eye witness of the case for not deposing against the accused persons. The learned counsel argued that the applicant who is complainant and sole eye witness is a sick man, suffering from serious ailment and apprehends his death any time, therefore, he wants conclusion of trial expeditiously
The learned counsel for opposite party no. 4 submitted that plea for applicant's discharge was not heard.
Having taken into consideration the submissions advanced on behalf of both the parties, the application is finally disposed of with the direction to the Additional Sessions Judge I, Jaunpur to conclude the trial of S.T. No. 132 of 2006-State Versus Shri Dhar Singh under section 302 I.P.C. and section 7 of Criminal Law Amendment Act, Police station Jalalpur, district Jaunpur within a period of four months from the date of production of certified copy or receipt of copy of this order.
Office is directed to send a copy of the order to the District and Sessions Judge, Jaunpur for communication and compliance.
