Ved Prakash Singh v. Chhotey Lal, D.I.O.S.& Others - CONTEMPT APPLICATION (CIVIL) No. 2380 of 2004 RD-AH 2060 (25 January 2006)
Hon. Tarun Agarwala,J.
The applicant filed a writ petition which was disposed of by judgment dated 5.11.2003 directing the District Inspector of Schools to take a final decision in accordance with law on the representation of the applicant. It transpires, that no decision was taken by the District Inspector of Schools, Ballia and accordingly, a contempt application was filed in which notices were issued, but unfortunately, the District Inspector of Schools could not be served and an impleadment application has now been filed.
In my opinion, no useful purpose would be served in issuing notice on the application and accordingly, this contempt application is disposed of with a direction to the applicant to approach the present incumbent holding the post of the District Inspector of Schools along with a copy of this order and also annexing the copy of the representation as well as the order dated 5.11.2003. Upon receipt of the aforesaid order and the application, the District Inspector of Schools, Ballia will decide the matter within two months.
