Vijay Dutt & Others v. Anil Swarup, Secy., Horticulture & Others - CONTEMPT APPLICATION (CIVIL) No. 2419 of 2003 RD-AH 2061 (25 January 2006)
Hon. Tarun Agarwala,J.
This Court by judgment dated 10.3.2003 directed the opposite parties to regularize the services of the applicant on or before 31.7.2003.
It has now come on record that the opposite party eventually passed an order of regularisation on 5.4.2004. In my view, certain latitude is required to be given to the opposite party to comply with the order. Since the order has now been complied with, I do not find any justification to continue any further with the contempt proceedings.
The contempt application is rejected.
The applicant alleges that the service book, increment etc. pursuant to the order of regularisation is not being done by the opposite parties. The Contempt Court is not concerned with regard to this aspect of the matter. If the applicant is aggrieved he should approach the proper forum for that purpose.
