Heard learned counsel for the applicant amd the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. only on the basis of last seen. There is no other evidence against the applicant and there is no direct eye witness account.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Kanhaiya alias Kanha involved in case crime no. 103 of 2002, under Sections 302 and 201 I.P.C. , P.S. Jhinjhana District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
