Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant was released on bail in the present case but subsequently due to some unavoidable circumstances, he could not appear in the court, so his bail was cancelled. He undertakes that he shall appear regularly in the court during pendency of the trial. He is in jail since 29.1.2005.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Singh involved in case crime no. 122 of 1999 (S.T.No. 68 of 2000) under Sections 394,302,307,412 I.P.C., P.S. Jahanabad District Fatehpur be released on bail on his furnishing a personal bond and heavy sureties to the satisfaction of the Court concerned.
