Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that there is cross version of the alleged incident. From both side F.I.Rs have been registered and both side have received injuries. From the side of the prosecution three persons have lost the lives and one person received injuries. From the side of the applicant one person lost the life. The injuries caused to the applicant side have not been explained. The prosecution has not come with clean hand.The co-accused Jabar Singh has been released on bail by this court on 28.11.2006 in criminal misc. bail application no. 23030 of 2006 and the co-accused Gyanendra alias Sher Singh has been released on bail by this court on 8.11.2006 in criminal misc. bail application no.23685 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Brijesh involved in case crime no. 165 of 2006 under Sections 147,148,149,307,302 and 504 I.P.C., P.S. Khaga District Fatehpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
