Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The F.I.R. was lodged on 1.2.2003 at about 11.00 a.m. in respect of the incident which had occurred on 31.1.2003 at about 3.00p.m. The F.I.R. is delayed even then the name of the applicant has not been disclosed. One day after the loding of the F.I.R.the name of the applicant has been disclosed by the witnesses. The naming of the applicant is after thought. The case of the applicant is distinguishable with the case of the co-accused Jairam Kewat.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jagdish involved in case crime no. 2 of 2003 under Sections 302 I.P.C., P.S. Bahel Purwa District Chitrakut be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
