The petitioner is relying upon the judgment passed by this court in the earlier occasion being dated 10th November, 2005 with regard to giving the actual arrears enhanced pensionary benefit on the basis of notional promotion passed in writ petition no.2877 of 2004 ( Dr. Rajendra Prasad and others vs State of U.P. & another) connected with writ petition No.7742 of 2004 (Dr. Chandra Prakash and others vs State of U.P. and another ). On the same analogy the petitioner has made a representation on 4th April, 2006 and reminder on 10th September, 2006, but according to him all are in vain.
Therefore, in disposing the writ petition, we direct the petitioner to file a fresh representation before the respondents within seven days from the date of obtaining the certified copy of this order. In such case, the representation will be decided by the respondents within a period of one month from the date of getting the representation upon giving fullest opportunity of hearing and by passing a reasoned order thereon. For the purpose of effective adjudication, a copy of the writ petition along with its annexures can be treated as part and parcel of the representation.
Thus, the writ petition is disposed of.
However, no order is passed as to costs.
