Heard Sri Anil Kumar Mishra, learned counsel for the accused applicant, learned A.G.A. and peruesed the record.
Accused Bajrangi Pandey sonof Shiv Narain Pandey has prayed for release on bail in Case Crime No. 1146/05 under Section 3/7 E.C. Act and Sections 409, 411 IPC, P.S. Chopan, District Sonebhadra.
According to prosecution case 200 bags of rice were found by the Police at the House of Ramchandra Chaubey. This rice was for food for work programme. Learned counsel for the accused applicant has contended that applicant was working as Secretary of Sadhan Sahkari Samity, Chopan and he had issued these bags to Shivendra Singh, junor engineer. He has also referred to paper annexure no. 2 and 3 and contended that this rice was received by aforesaid junior engineer. He has further contended that main allegations are against Shivendra singh, junior engineer and accused has not been named by the persons who were arrested along with rice.
Considering the facts and circumstances of the case, but without prejudice to the merits of the case, accused is entitled to bail.
Let the accused named above be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. He shall give an undertaking that He will not indulge in any criminal and antisocial activity and shall neither threaten the complainant/witnesses nor temper the witnesses and if any report is found against him, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
