Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version alleged occurrence had take place on 2.10.2006 at about 7.30 p.m., its F.I.R. has been lodged on 11.10.2006 at about 16.00. The F.I.R. is delayed without any plausible explanation. According to the F.I.R. the alleged occurrence has taken place in a sudden quarrel. He used danda blows consequently the deceased received injuries. The age of the applicant is aged about 65 years.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Satya Narain Singh involved in case crime no. 112 of 2006 under Sections 304,504 I.P.C., P.S. Chakia District Chandauli be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
