The submission of Shri S.P. Lal counsel for the petitioners is that the Consolidation Officer had passed an order dated 23.7.1977 allowing the objection of the petitioners and the Gaon Sabha has filed an appeal before the Settlement Officer Consolidation which is still pending and consequently the direction given by the authorities below that a FIR be lodged against the petitioners for forgery in the revenue records is uncalled for as no finding has been recorded by the authorities below that the order of the Consolidation Officer is a forged one.
Learned standing counsel represents respondent nos. 1 to 5. Gaon Sabha, respondent no.6 is represented by Shri Anuj Kumar. Respondents pray for and are granted six weeks time to file counter affidavit. Petitioners will have three weeks thereafter to file rejoinder affidavit.
Until the next date of listing the operation of the order of the Board of Revenue dated 20.10.2005 shall remain stayed to the extent to which a direction has been issued to lodge the FIR. It is made clear that proceeding regarding correction of the entries shall go on and in case it is found that the order of the Consolidation Officer is a forged one a direction to lodge the FIR may also be given.
