Heard Sri Prabhat Kumar Srivastava, learned counsel for the applicant, learned AGA and have perused the materials on record.
The learned counsel for the applicant submitted that the contents of the first information report read as a whole do not make out a case for proceeding under section 409 I.P.C. The learned counsel argued that the applicant was working as Assistant District Government Advocate and loss of four case diaries was caused due to theft and the applicant lodged the first information report about theft.
The learned AGA submitted that disappearance of four case diaries was caused by the applicant intentionally and deliberately for wrongful gain.
Having taken into consideration the submissions advanced on behalf of both sides, this application under section 482 Cr.P.C. is finally disposed of with a direction to the applicant to seek discharge by making an application before the trial court and in case an application for discharge is made the same shall be decided by the trial court expeditiously.
