Heard learned counsel for the applicant and the learned A.G.A. and Sri R.N. Rai, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the applicant is not named in the F.I.R. During investigation the name of the applicant has been disclosed after great though and consultation. The co-accused Ankush Chauhan has been released on bail by this court. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ashutosh Tyagi involved in case crime no.346 of2006 under Sections147,148,149, 303,323,304 I.P.C. P.S.Kasna District Gautam Budh Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
