1. There is a godown in Khata no. 189 and 184 situate in village Badhar Sadabad district Hathras. The petitioner claims himself to be the tenant of this godown. This godown was requisitioned by the District Magistrate by order dated 16.6.2001. The petitioner filed writ petition no. 28469 of 2001. It was disposed of on 2.8.2001 granting liberty to the petitioner to file fresh representation. The petitioner filed fresh representation on 1.9.2001 on which an order was passed on 6.9.2001. Thereafter the order dated 6.9.2001 was stayed by another order dater 6.10.2001 for obtaining opinion of the DGC(Civil). According to the petitioner, no further order has been passed, hence the present writ petition.
2. We have heard counsel for the petitioner and the standing counsel for the respondents.
3. The order dated 6.9.2001 has been stayed by order dated 6.10.2001 by the District Magistrate. The result is that the representation of the petitioner dated 1.9.2001 is still pending. There is already an order of this court dated 2.8.2001 to dispose of this representation. It would be appropriate that the District Magistrate should immediately decide the representation of the petitioner dated 1.9.2001. The petitioner will also have liberty to file contempt proceedings or file an application in WP No. 28469 of 2001. With these observations the writ petition is dismissed.
