Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been lodged after two and half months of the alleged occurrence i.e. 20.8.2006 at about 2.30 in respect of the incident which had occurred on 8.6.2006. The F.I.R. has been lodged on the basis of doubt and suspicion because the applicant was having illicit relation with the wife of the deceased. During investigation the I.O. collected the evidence in which the same witnesses stated that the applicant was seen carrying the skeleton of the deceased in bag. There is no direct eye witness account. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Laxmi Prasad
involved in case crime no. 320 of 2006 under Sections 302,201 I.P.C., P.S. Mahobkanth District Mahoba be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
