Heard Sri Manish Tiwary, learned counsel for the applicant and learned A.G.A. and perused the papers.
The main submission made by the learned counsel for the applicant is that authority who has granted sanction has no power in law to grant the sanction and since the sanction is not in accordance with law, hence, the chargesheet should be quashed.
Let notice be issued to opposite parties to file counter affidavit within six weeks.
Rejoinder affidavit may be filed within two weeks thereafter.
Till the next date of listing, further proceedings in case No. 625/2006 (State versus Vinod Kumar and others) under Section 420/467/468/471 I.P.C., P.S. Civil Lines, District Meerut pending in the Court of C.J.M., Meerut shall remain stayed.
