Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is the father in law of the deceased. He was living separately. He was having no concern with the demand of dowry and subjecting the deceased to cruelty. He is an old man aged about 70 years. The co-accused Smt. Girija Kumari, mother in law of the deceased, has been released on bail by this court on 6.12.2006 in case crime no. 26725 of 2006. The cause of death is poisoning. No ante mortem injury was seen on the person of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Riggu alias Sardar Pandey involved in case crime no. 62 of 2006 under Sections 498-A,304-B,I.P.C., and ¾ D.P. Act P.S. Mau District Chitrakoot be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
