Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the alleged occurrence has taken place in a sudden quarrel. It was not pre-intended. The injury no.2 of the deceased was fatal, it has not been specified who caused this fatal injury. The co-accused Budhi Ram alias Baggad Pal whose case was on the same footing has been released on bail by this court on 16.11.2006 in criminal misc. bail application no. 24927 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Kesh Pal involved in case crime no. 627 of 2006 under Sections 452,323,504,308,304 I.P.C., P.S. Aharaura District Mirzapur be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned.
