Heard Sri Rajendra Rai, learned counsel for the applicants and learned A.G.A. and perused the record.
It is submitted that the applicants are not named in the FIR, and supplementary, chargesheet has been submitted against them, which should be quashed. From the record it transpires that the allegations have been prima facie established. Therefore, this court will not be justified to set aside the chargesheet as prayed. However, direction may be issued to the court below to decide the bail application of the applicants expeditiously.
Hence, the Courts below are hereby directed to decide the bail applications of the applicants expeditiously, if they appear within a period of one month from today keeping in view the observations made by this Court in Smt. Amrawati and another versus State of U.P. Reported in 2004 (57) ALR (290).
For a period of one month from today, the applicants will not be arrested in case crime no. 354 of 2000, under sections 363, 366, 376 and 506 IPC, P.S. Ghosi, District Mau. In case the applicants fail to appear within the aforesaid period in the court below, this stay order shall automatically stand vacated.
with these observations this application under Section 482 Cr. P.C. is finally disposed of.
