Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation evidence of extra judicial confession has been collected by the I.O. Some of the witnesses stated that the applicant was seen rooming near the place of occurrence. There is no other evidence against the applicant. There is no eye witness account.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Veeran Pasi involved in case crime no. 24 of 2005 under Sections 302,120-B I.P.C., P.S. Puramufti District Kaushambi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
