Heard Sri Mithilesh Kumar Tiwari, learned counsel for the applicant and learned A.G.A. and also perused the record.
The proceedings of criminal case No. 583 of 1997 under Section 323, 504 I.P.C. and Section 3 (1) (10) of S.C. & S.T. Act, P.S. Nagina, Bijnor pending in the Court of A.C.J.M. Nagina, Bijnor has been sought to be quashed. The chargesheet has been submitted against the applicants and the lower Court has taken cognizance. Therefore, quashing of chargesheet in aforesaid case will not be justified.
Therefore, this case is finally decided with the direction that if the applicants surrenders themselves before the lower court concerned and apply for bail, then their bail applications will be decided expeditiously keeping in view the observations made by this Court in the case of Smt. Amrawati and another versus State of U.P. Reported in 2004 (57) ALR (290) and having regard to the fact that the parties have compromised the matter and are said to have filed compromise in the court below.
