Heard learned counsel for the applicant and the learned A.G.A.and Sri P.C. Srivastava, leaned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The name of the applicant has come in the statement of the witnesses and at the pointing out of the appliant one dead body was recovered from an open place. The recovery is not supported by any independent witness. There is no other witness agaisnt the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Hariom alias Hariom Yadav involved in case crime no. 556 of 2006 under Sections 365,394,302,201,411 I.P.C., P.S. Kotwali District Budaun be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
