Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by the learned counsel for the applicants that the applicants are not named in the F.I.R., but during investigation the I.O. has come to conclusion that they were falsely implicated that is why charge sheet was ot submitted against the applicants, whereas the charge sheet was submitted against co-accused Harish and other co-accused persons. Co-accused Harish has been released on bail. The applicants have been summoned by the trial court in exercise of powers conferred under Section 319 Cr. P. C.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Madan Lal, Beche Lal and Radhay Shyam involved in case crime no. 364 of 2002, , under Sections 364, 302 and 201 I.P.C. P.S. Meerganj District Bareilly be released on bail on their furnishing a personal bond and two sureties to the satisfaction of the Court concerned.
