By means of the present writ petition, the petitioner has sought a writ of mandamus directing the  the court below to decide  case no. 401 of 1994 ( Rambabu Vs. Nagar Palika Parishad and others) pending in that court.  

Heard  the learned counsel for the petitioner as well as  the learned Standing Counsel for the respondents.

The sole grievance of the petitioner is  is that  his civil suit as mentioned above is pending in the court of  the Civil Judge ( Senior Division ) Kaasganj, ETah. This Court is not aware of the prevailing  condition of the district courts and the burden on the case diary of the learned Judge there. The petitioner should have been advised to approach the Presiding Officer concerned for early  disposal of the case or the District Judge for appropriate  orders, as may be deemed proper.

The writ petition is dismissed in limine subject to  above observations.  

No order as to costs.
