Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is Nandoi of the deceased. He was having no concerned with the demand of dowry and subjecting the deceasd with cruelty. He was living separately. His case is distinguishable with the case of the other co-accused. The cause of death is due to burn injuries and there is no dying declaration.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Safat alias Safaq Ahmad involved in Case Crime No. 02 of 2005, under Sections 498-A and 304-B I.P.C. and Sections ¾ Dowry Prohibition Act, Police Station Kalyanpur , District Fatehpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
