Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is husband of the deceased. Asccording to the prosecution version the marriage of the deceased was solemnized with the applicant about 3 years prior to the alleged incident. There is dying declaration of the deceased which was recorded by the learned Magistrate, in which she stated that she was caught by fire accidently. She has not made any allegation against the applicant and other co-accused persons.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Subhash involved in Case Crime No. 92 of 2006, under Sections 498-A nd 304-B I.P.C. Police Station Dankaur , District Gautambjddh Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
