This is a writ petition against the order dated 28.11.2001 passed by respondent no.1 directing the petitioner to leave the part of the house.
We have heard learned counsel for the petitioner and counsel for the respondents.
The petitioner in paragraphs no.2 and 3 of the writ petition has stated that there was no allotment order. However, initially petitioner's father was the tenant of one Sri Ram Chandra and after death of his father he is the tenant of the premises in dispute. It is further stated that after death of Ram Chandra this premises has been inherited by Hira Lal respondent no.4. These paras have not been denied in counter affidavit filed by State respondents.
In view of this the order dated126.96.36.1991 passed by respondent no.1 appears to be illegal and is hereby quashed. It will be open to the respondent to take appropriate action in accordance with law.
This writ petition is disposed of.
