Heard counsel for the petitioner.
By this writ petition filed in public interest litigation, the petitioner prayed for mandamus commanding the respondents No. 1 & 2 to take effective measures against the gang of illegal money lenders. It has further been prayed that mandamus be issued to respondents No. 2 to 4 not to give effect their orders transferring the police officers posted at district Varanasi.
The grievance of the petitioner is that several cases have been registered against persons engaged in money lending. The petitioner himself has stated to have filed a first information report on which criminal case has been registered. The petitioner's grievance is that certain police officers who were the Nodal authority have been transfered out of the district and no effective measure are being taken. We are afraid that the relief claimed in this writ petition, cannot be entertained as public interest litigation. It is not for this Court to monitor criminal investigation or to interfere with transfer of police personnels by the authorities competent. Petitioner himself has already lodged first information report which shall take due course of law.
With the aforesaid observation the writ petition is dismissed.
